1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Midlife Medicine website at midlifemedicine.com, the patient portal, and related online services (collectively, the "Site"), operated by Midlife Medicine ("Midlife Medicine," "we," "us," or "our"). By visiting the Site, submitting a form, booking an appointment, or using the patient portal, you agree to these Terms. If you do not agree, please do not use the Site.
2. Description of the Site
The Site provides information about Midlife Medicine's direct-care menopause, perimenopause, hormone therapy, and life-coaching services, and offers tools such as contact forms, a mailing list, and links to the patient portal for booking, intake, and secure communication. The Site is informational and administrative in nature; it does not provide medical advice, diagnosis, or treatment, and using the Site does not create a physician-patient relationship. A physician-patient relationship is established only after you complete intake and scheduling through the patient portal and begin care with Midlife Medicine.
3. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site or to submit information through it on your own behalf. Midlife Medicine provides care to eligible patients located in Virginia or Washington, D.C. at the time of a virtual visit, as described further on the Site and in our service area information. Use of the Site does not guarantee eligibility for any particular service.
4. Accounts and the Patient Portal
Scheduling, intake, secure messaging, and billing are handled through our third-party patient portal (currently Practice Better). Your use of the portal is also subject to that provider's own terms and privacy policy. You are responsible for maintaining the confidentiality of your portal login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorized access to your account.
5. Prohibited Use
You agree not to:
- Use the Site to submit false, misleading, harmful, unlawful, or malicious content.
We may suspend, restrict, or terminate access to portal features if we believe access is unauthorized, unsafe, abusive, unlawful, or inconsistent with these Terms.
6. Website Forms and Communications
The public website may include contact forms, mailing-list forms, booking links, phone links, email links, and other communication options. When you submit a form or contact us, you agree that the information you provide is accurate and that we may use it to respond, follow up, route the inquiry, maintain records, and operate our practice.
Public website forms are not intended for sensitive clinical details, urgent medical issues, or emergencies. If you are a patient, use the patient portal or secure communication channel we have directed you to use for clinical matters.
Email, ordinary SMS, and public website forms may not be fully secure. By choosing to communicate through those methods, you acknowledge the limits of those channels.
7. SMS Text Messaging Terms
Midlife Medicine may use SMS text messaging for communications related to services we provide or may provide to you, including administrative issues, scheduling, billing, care reminders, and other service-related communications.
By opting in, you agree to receive SMS text messages from Midlife Medicine. Message and data rates may apply. Message frequency varies. You may text STOP at any time to opt out of SMS text messages. You may text HELP at any time for help. Carriers are not liable for delayed or undelivered messages.
SMS consent is not a condition of purchasing services unless specifically required for a particular communication workflow and permitted by law. If you opt out of SMS, we may still contact you through other permitted channels.
My SMS platform provider, Spruce Health, supplied me with model verbiage to use in conjunction with my standard agreement paperwork in order to collect opt-in consent for SMS texting which can be reviewed below in the "SMS Text Messaging Terms of Service" and "SMS Text Messaging Privacy Policy."
When I submitted my registration, I indicated that I had incorporated that language, or substantially similar language, into my standard agreements; therefore, the SMS platform provider has submitted this attestation, on my behalf:
Our standard terms of service and privacy policy describe our SMS text messaging program. Users receive SMS messages only after providing separate, affirmative consent to opt in, as described inĀ "Details of How My Organization (Midlife Medicine) Obtains SMS Opt-In."
Please note that I, from time to time, make use of agreements that are not available on any public website, such as agreements on paper forms or agreements that are accessible only via private online forms. So while I am faithfully and consistently gathering SMS opt-ins via specific contractual language, as described below, this language is not necessarily present on any publicly available website.

8. Appointments, Fees, Payments, and Practice Policies
Appointments, services, packages, fees, cancellation terms, refund terms, payment requirements, consent forms, and clinical policies may be governed by separate agreements, patient portal terms, intake documents, invoices, or practice policies.
If information on the Site conflicts with a signed agreement, patient consent, invoice, portal document, or written practice policy, the signed agreement, patient consent, invoice, portal document, or written practice policy controls to the extent permitted by law.
Prices, availability, programs, services, and policies may change. We may correct errors or update information at any time.
9. Marketing, Tracking Links, and Analytics
The Site may use first-party analytics, tracking links, campaign links, URL parameters, local storage, session storage, session cookies, and similar technologies to understand website usage, measure campaign performance, attribute form submissions, improve the Site, and operate the practice.
Tracking links may redirect you to destination pages and add campaign parameters to the URL. Public website activity may include page views, clicks, form starts, form submissions, device information, browser information, referrers, campaign identifiers, hashed IP address, and approximate location derived from technical headers.
Your use of the Site is also subject to our Privacy Policy and, where applicable, our HIPAA Notice of Privacy Practices.
10. Intellectual Property
The Site and its content, including text, design, layout, graphics, logos, images, videos, icons, code, and other materials, are owned by Midlife Medicine or its licensors and are protected by intellectual property laws.
You may view, download, or print a reasonable copy of public Site content for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, sell, create derivative works from, or publicly display Site content without our prior written permission, except as permitted by law.
All trademarks, service marks, names, and logos used on the Site are the property of their respective owners.
11. User Submissions
If you submit information, messages, form content, feedback, testimonials, comments, files, or other materials through the Site or related channels, you represent that you have the right to submit that information and that it is accurate to the best of your knowledge.
You agree not to submit content that is unlawful, threatening, defamatory, harassing, abusive, discriminatory, obscene, misleading, infringing, malicious, spam, or otherwise harmful.
Unless otherwise stated in a separate agreement, you grant Midlife Medicine the right to use submitted information as reasonably necessary to respond to you, provide services, operate the practice, maintain records, comply with law, protect rights and safety, and improve our services.
12. Privacy and Health Information
Your use of the Site is subject to our Privacy Policy. Certain health information may also be subject to HIPAA or other health privacy laws and to Midlife Medicine's HIPAA Notice of Privacy Practices, if applicable.
These Terms do not replace any HIPAA Notice of Privacy Practices. If there is a conflict between these Terms and an applicable HIPAA Notice of Privacy Practices regarding protected health information, the HIPAA Notice of Privacy Practices controls.
13. No Warranties
The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Midlife Medicine disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, availability, fitness for a particular purpose, merchantability, non-infringement, and uninterrupted or error-free operation.
We do not warrant that the Site will be secure, available, uninterrupted, free from errors, free from harmful code, or compatible with every device or browser.
14. Limitation of Liability
To the fullest extent permitted by law, Midlife Medicine and its owners, clinicians, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or business opportunity, arising from or related to your use of or inability to use the Site.
Nothing in these Terms limits liability that cannot legally be limited, including liability for gross negligence, willful misconduct, or other liability that applicable law does not allow us to exclude.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Midlife Medicine and its owners, clinicians, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your misuse of the Site, violation of these Terms, violation of law, infringement of rights, or information you submit.
16. Changes to the Site and Terms
We may update, suspend, discontinue, or modify the Site, features, content, links, or services at any time. We may also update these Terms from time to time. The updated version will be identified by its effective date or last updated date.
Your continued use of the Site after updated Terms are posted means you accept the updated Terms, to the extent permitted by law.
17. Governing Law
These Terms are intended to be governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles, unless applicable law requires otherwise. Any legal venue, dispute resolution requirement, or arbitration provision should be reviewed by counsel before publication.
18. Severability
If any part of these Terms is found unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.
